Trusted Brands and their Lookalikes

We all have gone through with many trusted brands and their lookalike products as well. These products can be seen on the shelves of the supermarket as well as the local store. These lookalikes products have covered the almost whole market. These lookalikes are registered companies but still to improve their sales these companies are using established brand name and provide products at less price.

These types of activities are hampering the sales of these trusted brands. As well as it also increases customer dissatisfaction. These lookalikes copy the packaging style of the product as well as use a similar brand name, which confuses the customer and many customers didn’t realize the difference in both the products. These products trick the customers and sell cheap products at a high price.

Trademark Infringement:

Many companies’ lookalike uses the company’s trademark by doing a little change which can’t be noticed by the customer very easily. This action confuses the customer and customer purchases the product which was not authentic and original. This makes an illegal use of any company’s trademark and the genuine company may file a lawsuit against the copier company. If the company found guilty of using opposite companies trademark without their consent and illegally, they have to pay the amount of damage money. In short, the respected court will impose a fine over the company and they have to pay the amount which the genuine company lost due to duplication.

The trusted branded company also have the Copyright over their products. It means no other company is allowed to produce the same product without their permission. If it so, then the company who tried to copy the product will have to face a lawsuit and a defined punishment from the respected judiciary.

The Trademark infringement is the best solution for any reputed company who have the chances to face the copying of product or product duplication. Trademark law protects the only registered trademark. Passing off is usually more difficult to prove than trademark infringement, this is the reason why brand holders are suggested to register their brands and packaging as their trademark.

Unfair Advantage:

When the customer is using the fake or lookalike product and the customer is unable to distinguish between the real and the duplicate product. This gives the unfair advantage to the copying company and the customers are using that specific product without any doubt. It produces a good revenue for the lookalike company. The unsatisfied customer due to lookalike will not try the product again and wouldn’t come along to the original product and couldn’t make the difference between the Trusted Brands and their lookalikes.

The Trademark Protection will provide an unsaid advantage to the trusted brand. The court will see its reputation, goodwill, and damage of goodwill on that basis the punishment has been awarded to the lookalike company. It will benefit the trusted brand company that the point of confusion will not be entertained by the respective judiciary.

Conclusion:

The clash will continue between the trusted brands and the lookalike brands and maybe these incidents will increase. It’s the only solution could be an attentive and aware action by the branded companies, like registering themselves, register a unique trademark to protect their brands and packaging, copyright their unique product. In addition to this, keep an eagle eye on their competitive markets and identify the copying companies at an early stage. These could be the precautionary step by the trusted brand’s company to save themselves by their own from these types of market loss.
