# Whistleblower Claims would be Used by Musk, Judge would not Delay Twitter Trail

[Elon Musk](https://yourviews.mindstick.com/view/85512/elon-musk-mark-zuckerberg-two-business-tycoon-of-similar-age)'s would be using a whistleblower's claims in his legal case against **Twitter** however the billionaire would not delay the trial over his plan to go forth from his **[$44 billion](https://www.mindstick.com/news/1624/elon-musk-may-not-own-the-twitter-in-44-billion-which-he-agreed-before-says-investors)** deal for the company.

The **Chancellor of Delaware's Court of Chancery** has mentioned in affirming the trail which would start next month that '**I am convinced that even four weeks’ delay would cause more damage to Twitter**.'

During the early **Wednesday** trading, the shares rose by **4 percent to $40.15**.

**Alex Spiro** an attorney for Musk in a statement had mentioned that “**We were hopeful that winning the motion to amend would take us one step nearer to the reality coming out in the courtroom**.'

Musk's legal team argued on **Tuesday** that justice had demanded delaying the five-day trial thus Musk may investigate claims by [whistleblower](https://www.mindstick.com/news/1922/whistleblower-claimed-that-twitter-misled-regulators-on-hackers-and-spam) **Peiter Zatko**, called '**Mudge**,' that Twitter hid weaknesses in its [security and data](https://www.mindstick.com/forum/160346/explain-the-security-and-data-integrity-challenges-associated-with-nosql-databases) privacy.

Musk's initial case against Twitter claimed that the company misrepresented the prevalence of spam or bot accounts on the platform.

Last month, Zatko's allegations became public and provided Musk, the world's [richest person](https://yourviews.mindstick.com/view/86768/adani-group-founder-gautam-adani-is-once-again-asia-s-richest-person), recent ammunition to bolster what legal consultants have mentioned was a long-shot plan to go forward without even paying a **$1 billion** termination fee.

In **July**, Twitter sued Musk who was also a chief executive of electrical vehicle maker **Tesla** in order to carry him to his **April** [agreement](https://yourviews.mindstick.com/view/88513/what-to-look-for-in-a-retainer-agreement-with-defence-lawyers-in-dubai) to purchase the company for **$54.20 per share**. The company has alleged that Musk got cold feet over the deal as [international](https://yourviews.mindstick.com/view/85496/celebration-of-international-chocolate-day) politics and [inflation](https://answers.mindstick.com/qa/41628/what-factor-led-to-inflation-in-the-confederacy) rattled markets just after the deal was signed.

Late on **Wednesday**, **McCormick** ordered Musk and **Jared Birchall** who had helped to manage Musk's wealth, to get and switch off phone records to permit Twitter to verify that Musk had not texted about the deal during the initial periods.

At Tuesday's hearing, Twitter's lawyer had read a message from Musk that came to light during the [litigation](https://answers.mindstick.com/qa/116546/when-is-it-better-to-hire-a-litigation-lawyer-in-dubai-instead-of-opting-for-arbitration) that the lawyer mentioned that showed the billionaire was not exactly concerned about the spam accounts.
